Box 5022, Wallingford, 06492-7522. MARKIE, Alcide J. Alcide J. Markie, 90, of Markie Farmington, beloved husband for 67 years of Mabel (Labbie) Markie, died Sunday, (April 7, 2002) at home, -after a long illness which he fought with much strength and courage. Mr.

Markie was born in Eagle Lake, ME on April 30, 1911, and was a son of the late George and Clara (Chasse) Markie. A resident of Farmington for the past 47 years, he was employed at the New Departure Division of General Motors for 33 years before retiring in 1973. He was a member of St. Matthew Church, Forestville. In addition to his wife, Mr.

Markie is survived by three sons, Alcide "Ted" Markie and his wife Pat of Avon, Eugene Markie and his wife Marge of Middletown, and Paul Markie and Pamela Foldvary of Glastonbury; three daughters and a son-in-law, Mona and Ira Bachand of Colebrook, Carol Zimmer of Southington, and Diana Markie of Farmington; a brother, Alte Markie of Simsbury; 11 grandchildren; 13 eral great nieces and grandchildren; al nephews. Allan "Bud" E. Martin, 80, of East Windsor, beloved husband of Jeanne -(Thorpe) Martin, died Monday, (April 8, 2002) at a local convalescent home. Born in North Woodstock, NH, son of the late William and Retta (Hart) Martin, he lived in Windsor Locks and Enfield before moving to East Windsor last year. Prior to his retirement, Allan was employed by Amerbelle Rockville, for many years. He was U.S.

Army veteran World War II. He was an active member of Bethany Baptist Church, East Windsor, where he was Assistant Treasurer, and: a leader in the Christian Service Brigade. Allan spent many hours helping to construct the church. Besides his loving wife of over 55 years, he is survived by a brother, Raymond Martin of Burbank, CA; a sister-in-law, Etta Martin of North Woodstock, NH; a niece, Sharon Bartlett of Lincoln, NH; three nephews, Steven Martin of Woodstock, NH, James Martin of Lincoln, NH and Gerald Martin of Montana. Cornelia was born in New York City, NY on Jan. 26, 1912, daughter of Frederic C. and Edna Bushnell (Post) Hirons. Cornelia was a direct descendant of Thomas Hooker and David Bushnell. Cornelia resided in East Hartford for 30 years.

She was a retired chemist from Pratt Whitney, East Hartford. Cornelia is survived by her brother, Frederic C. Hirons of Cincinnati, OH; a sister, Priscilla B. Watson of Memphis, TN; and nieces and nephews. Funeral services will be private with burial in the Cypress Cemetery, Westbrook.

Michael R. Procaccini, 92, of Wethersfield, husband of the late Evelyn (Cappelli) Procaccini, died Sunday, (April 7, 2002) at a local convalescent home. Born in Hartford, he was the son of the late Mr. and Mrs. Angelo Procaccini and lived in Wethersfield since 1966.

He retired from Pratt Whitney Aircraft after 44 years of service. He is survived by two sons and daughters-in-law, James and Joyce Procaccini of West Hartford, and Mark and Cynthia Procaccini of Wethersfield; two daughters and a son- Joyce Lacus of Wethersfield, and Gail and Thomas Finley of Rocky Hill; a brother, Victor Procaccini of Wethersfield; three sisters, Ann Armillei of Wethersfield, Helen LeBlanc of Newington, and Florence Uterstaedt of New Britain; 12 grandchildren; and four great grandchildren. He was predeceased by three brothers, John, Anthony, and Umberto Procaccini; a sister, Louise Narkewich; and a former son-in-law, John Lacus of Vernon. Smith of Springfield, MA, departed this life at Mercy Medical Center, Springfield on Friday, (March 22, 2002). He was born and raised in Hartford and lived in Springfield for 35 years. She is survived by her son, Kenneth J. Scharmann of Illinois; and by her three daughters, Judith A. Max and her husband, Stephen of Houston, TX, Karen Tedrow and her husband, Robert of Woodbridge, VA, and Aileen Matta and her husband, Antonio of East Hartford. Veronica also leaves her eight grandchildren, Jennifer A. and David J.

Max, Hillary Scharmann, Joseph P. and Patrick W. Tedrow, and Antonio Veronica and Catherine A. Matta. She is also survived by, her brother, Thomas Rogers Willis Park, NY; and by her sister, Cecelia O'Malley of Seaford, NY.

William J. Schmidt, 72, of Rocky Hill, died Monday, (April 8, 2002) at a local convalescent home. He was born in Webster, MA, and had been employed at Pratt Whitney Aircraft. He served in the U.S. Navy during World War II.

He was a member for the Masonic Lodge AF AM of Newington. He is survived by a son, William D. Schmidt of Ellington; a daughter, Katherine L. "Bing" J. "Bing" Shimeld, 74, of Unionville, husband of Ruth M. (Sandstrom) Shimeld, died Sunday, (April 7, 2002) at St. Francis Hospital and Medical Center. Born in Unionville, November 13, 1927, son of the late Francis P.

and Rose Niksa Shimeld, he resided in town all of his life. He was a graduate of Farmington High School, Class of Prior to retiring, Bing was the owner and operator of Shimeld's Store in Unionville for 26 years. He was a communicant at The Church of St. Mary Star of the Sea, served in the U.S. Navy during World War II, and was a member of the of Uncas Council Unionville.

He was very active in sponsoring, supporting and managing Farmington Little League. Besides his wife, he is survived by his five children and their spouses, Dorothea S. and Wayne Lenik of Unionville, Margaret S. and David DiGiulio of Cincinnati, OH, Thomas F. Shimeld and Francis P.

Shimeld, both of Unionville, Michael and Janice Shimeld of Unionville; 12 grandchildren, David, Karen and Laura DiGiulio, Stephan and Lenik, Rebecca and Stacy Shimeld, Krista Remaily, Allyson and Michael Jr. Shimeld, Jack and David Shimeld; and a great-granddaughter, Eva Remaily. His two aunts, Sally Niksa Ryan and Ann Niksa Lazorik, both of Florida. He was predeceased by a grandson, Michael E. DiGiulio.

WYRICK, William E. William E. Wyrick, 84, of Sun City, formerly of Winton East Windsor, husband of the late Elizabeth (Whalen) Wyrick, died Saturday (April 6, 2002). William was born in Webb City, MO and lived in East Windsor for more than 30 years. He was a U.S.

Navy Veteran of World War and had been a sales manager for the PhillipMorris Corp. in Hartford. William had been a member of the American Legion and the VFW. William is survived by his son and daughter-in-law, William J. and Jan (Haller) Wyrick of Anaheim, CA; a brother, Leland Musgrove of Dixon, CA; and two grandchildren.

in St. Patrick Cemetery, Fall River, MA. 4. DEATH NOTICES SMITH, Edmund G. Edmund Smith, 84, of Walpole, MA, formerly of Bristol, husband of Marjorie (Berry) Smith, died Sunday, (April 7, 2002) in Norwood, MA.

Mr. Smith was born in Hartford on June 15, 1917 was a son of the late Winfred and Lilla (Patterson) Smith. He was employed by the State of Connecticut Department of Revenue Services before retiring in 1982. A descendent of the Pilgrim James Chilton, he was a member of the Society of Mayflower Descendents, Connecticut Chapter, and had a lifelong interest in History and Genealogy. He also enjoyed gardening.

He was a veteran World War II, serving in the United States Army as a special agent with the Counter Intelligence Corps in Germany. In addition to his wife, Mr. Smith is survived by two daughters and sons-in-law, Linda and Christopher Lynch of Mashpee, MA, and Nancy and Mickey Amato of Walpole, MA; a brother, William Smith of Suffield; a grandson, Senior Airman Adam Lynch, USAF, of Great Falls, MT; and three nephews. Funeral services will be held on Wednesday, April 10, 11 a.m., at the First Congregational Church, 31 Maple Bristol. Burial, with Military Honors, will follow in Peacedale Cemetery, Bristol.

Relatives and friends may call at Funk Funeral Home, 35 Bellevue Bristol, TODAY, April 9, 4-7 p.m. Memorial donations may be made to a charity the donor's choice. www.funkfuneralhome.com TREMAINE, Burton Gad, Jr. Burton Gad served as president and chairman of the board of The Miller Company in Meriden, a leader in the production of copper-based alloys. He was 79.

He resided in Johns Island, Vero Beach, FL. Mr. Tremaine joined The Miller Company in 1947, advancing to president in 1955, a position he held for 32 years. At the time he joined the company, it was a leading producer of industrial commercial lighting fixtures and specialty copper alloy strip. Under Mr.

Tremaine's guidance, the company sold its lighting division and focused instead on modernizing the rolling mill for specialty metals. By 1985, The Miller Company had become a major producer of copperbased alloys used in electronics, automotive, telecommunication, and other industries. In 1987, Mr. Tremaine became chairman of the board, serving for 13 years until the sale of the company in June of 2000. Mr.

Tremaine's family had a lifetime interest in the arts. He sat on the Board of Trustees of the Wadsworth Atheneum, Hartford, from 1965 to 1985, serving as president from 1978 to 1981. He remained on the board as an honorary member until his death. During his tenure, he presided over the early phases of the $8,000,000 capital campaign to modernize the museum's entire physical plant and reinstall the collection in renovated galleries. He also served on the Board of Directors of the Hartford Stage Company.

Other beneficiaries of his interest in art were the Center for the Arts in Vero Beach, FL, and the Hotchkiss School in Lakeville, with the establishment of Tremaine Art Gallery. He was also involved in the restoration of the McKee Gardens in Vero Beach, FL. In 1991, he was the founding chairman of the Emily Hall Tremaine Foundation in Meriden. He guided the fledgling organization as it chose its three grant-making focus areas, learning disabilities, the environment, and the arts. He worked to engage fully other family members in the process of setting guidelines and planning strategy, stressing the importance of unity of purpose and collaborative problem solving.

By 1999, when he retired from the board, the foundation had become an effective grant maker, particularly in the area of learning disabilities. He served as chairman of the Board of Directors for Meriden Hospital in Meriden. He also served as chairman of the board of the Bar Bar Ranch in Flagstaff, AZ. The Bar Bar Ranch operates Meteor Crater, which has been under the management of the Tremaine family since the 1940's, when Mr. Tremaine's grandfather purchased the surrounding land.

Mr. Tremaine also had a keen interest in sailing, and had won many regattas. He was commodore of the Fishers Island Yacht Club and a member of the New York Yacht Club. Graduating from the Hotchkiss School, Class of 1940, and from Yale University, Class of 1944, Mr. Tremaine earned an A.B.

in History. He served with the 65th Infantry Division in Europe, rising to the rank of captain. Mr. Tremaine is survived by his wife, Catherine Burns Tremaine; two sons, Burton G. Tremaine, Ill of Essex, and John M.

Tremaine of New Canaan; a step son, Atwood Collins, Ill of Darien; two daughters, Janet Tremaine Stanley of Tacoma, WA, and Sarah C. Tremaine of Charlottesville, VA; a sister, Dorothy Tremaine Hildt of Palm Beach, FL and Gates Mills, OH; and 14 grandchildren. A memorial service will be held Saturday, April 13, 1 p.m., in the Asylum Hill Congregational Church, Hartford. will follow with the location to be announced at the service. Burton Gad Tremaine, a business executive and philanthropist, died Saturday, (April 6, 2002) in New Orleans, LA. For many years he State Court Ruling Favors Microsoft By EDMUND H. MAHONY COURANT STAFF WRITER The state Supreme Court ruled Monday that most state consumers cannot sue manufacturers for antitrust violations when it denied a Wallingford man's claim that he was overcharged at the retail level as the result of unfair, monopolistic business practices by Microsoft Corp. Andrew Vacco sued Microsoft after buying a personal computer loaded with the company's Windows 98 software from an office supply retailer in 1999. Vacco gued in his complaint that Microsoft had a monopoly position in the software market and that, as a result, an illegally inflated price was passed along to him.

Microsoft moved to dismiss Vacco's claim and argued that he had no standing to sue because his purchase had not been made directly from Microsoft. The suit was filed under state and federal antitrust laws and state unfair business practices laws. The state trial court hearing the complaint agreed with Microsoft; Vacco appealed. The unanimous state Supreme Court decision turned on whether Vacco purchased the software directly from Microsoft. Since the evidence showed that Vacco bought the computer, pre-loaded with software, indirectly through a retailer, the court ruled that Vacco lacked standing under Bernice (Trimmer) Wallen and lived most of his life in the Hartford area.

Employed most recently at Glastonbury Burner and Boiler, David was an expert in the field of auto sound and alarm security. In addition to his parents, he is surby a son, David Yott, Jr. of Hartford; a daughter, Jaime Yott Manchester; a granddaughter, Erica of Terryville; his grandfather, Lloyd Wallen of West Hartford; three sisters, Candice Price of West Hartford, Pamela Acosta of Georgia, Penny Fryer of West Hartford; three brothers, Randy Yott of Enfield, Eric Wallen of North Carolina, Jeff Wallen of Ellington; and many nieces and nephews. He was predeceased by a brother, Bryan Yott. Memorial period of visitation will be held Thursday, 4 p.m.

When it rejected the claim by Vacco, the court also dismissed parallel arguments by state Attorney General Richard Blumenthal, who entered the case as a friend of the court. "The state Supreme Court's decision provides additional evidence that Connecticut's General Assembly should afford stronger rights so that Connecticut consumers who have been forced to pay artificially inflated prices by illegal monopolists can recover damages- regardless of whether the product was purchased directly from that monopolist or through a retailer." In his arguments, Vacco pointed to language in state antitrust law that appears to allow "a consumer injured in its business or property" to recover triple damages and attorney's fees.

But the state Supreme Court ruled that the General Assembly subsequently amended the law "to make explicit its intent that the judiciary shall interpret the Antitrust Act in accordance with the federal courts." The federal courts, citing a variety of concerns, have been clear that only direct purchasers are entitled to bring antitrust claims against manufacturers. Vacco's lawyer, Ben A. Solnit, said Monday that state law and the decision published Monday are inherently unfair because consumers rarely make direct purchases from manufacturers. Crash Kills Passenger BY WILLIAM SCHUBERT COURANT STAFF WRITER BRISTOL A Plainville man who turned 21 Saturday was killed early Monday morning when the truck in which he was riding crashed into a telephone pole.

Jason L. Miron, of 57 Loomis was pronounced dead at the scene of the crash, which occurred just before 1 a.m. on Riverside Avenue, police said. The driver, Matthew G. Smart, 21, of 22 Rose was taken to St.

Francis Hospital and Medical Center in Hartford. He was listed in stable condition late Monday night. Local police late Monday would not comment on a wire service report that alcohol appeared to be a factor in the accident. Police said Smart was driving a 1985 Chevrolet S-10 pickup truck east on Riverside Avenue and it veered off the road. The right front and right side of the vehicle hit the pole and the impact tore the cab open and ripped the passenger-side door off, the police report said.

Miron was wearing a seat belt, police said, but suffered massive head injuries. Smart had cuts and bruises, the police report said, but was conscious and alert at the scene. Miron was born in New Britain and attended Plainville schools. He was working as a painter and was an avid fisherman. The accident is under investigation.
